Terms of Service

1. Welcome & Agreement

Welcome to Mapinly. These Terms of Service ("Terms") are a legal agreement between you and Mapinly. They govern your use of mapinly.com and all related services.

By creating an account or using Mapinly, you agree to these Terms. If you do not agree, please do not use our service.

We may update these Terms from time to time. When we make material changes, we will notify you by email or through an in-app notice. Your continued use of Mapinly after changes take effect means you accept the updated Terms.

2. What Mapinly Is

Mapinly is a collaborative trip planning platform. It helps groups of friends, families, and couples organize travel together in one workspace — combining maps, itineraries, budgets, notes, and idea lists.

What Mapinly is not. Mapinly is not a travel agency, booking service, or financial institution. We do not sell flights, hotels, or experiences. We do not process real payments between users — our budget tracking feature is an organizational tool to help groups keep track of shared expenses, not a financial service.

Features may change. We are actively building and improving Mapinly. We may add, modify, or discontinue features at any time. We will provide reasonable notice for changes that significantly affect your experience.

Third-party content. Mapinly uses data from third-party services including Google Maps and Pexels. This content is governed by those providers' own terms of service and may change or become unavailable outside of our control.

3. Your Account

To use Mapinly, you must create an account. By doing so, you agree to the following:

  • You must be at least 16 years old to create an account.
  • You may only have one account per person.
  • You are responsible for keeping your login credentials secure. If you believe someone has gained unauthorized access to your account, notify us immediately through our contact page.
  • You must provide accurate information when signing up and keep it up to date.
  • You are responsible for all activity that occurs under your account.

You can delete your account at any time from your profile settings. Deleting your account permanently removes your data.

4. Free and Paid Plans

Mapinly offers a Free plan and paid Plus plans.

Free plan. The Free plan includes 1 active trip, up to 5 collaborators, and up to 20 saved places. Trips on the Free plan are automatically archived 7 days after the trip end date.

Plus plans. Plus plans unlock unlimited trips, collaborators, saved places, custom lists, itinerary export, permanent trip storage, and priority support (annual plan only). Plus is available as a monthly subscription ($4.99/month) or an annual subscription ($35.99/year).

Current pricing is listed on our website. We may change pricing with at least 30 days' notice before the change takes effect on your next billing cycle.

5. Billing, Renewals & Cancellation

Paid subscriptions are billed through Stripe. By subscribing to a paid plan, you also agree to Stripe's terms of service.

Renewals. Monthly plans renew every month. Annual plans renew every year. You will be charged automatically on each renewal date unless you cancel before the renewal.

Cancellation. You can cancel your subscription at any time through the Stripe billing portal, accessible from your profile settings. Cancellation takes effect at the end of your current billing period — you keep access to Plus features until then.

No partial refunds. We do not provide refunds for unused time within a billing cycle. If you have a special circumstance, you can submit a refund request through our contact page.

Failed payments. If a payment fails, Stripe will retry the charge several times. If payment cannot be collected after multiple retries, your subscription will be cancelled. Your data is not deleted — your account reverts to the Free plan and your data remains accessible within Free plan limits.

6. Acceptable Use

Mapinly is built for planning trips together. When using our service, you agree not to:

  • Use Mapinly for any unlawful purpose.
  • Upload or share content that is illegal, harmful, threatening, abusive, defamatory, or that violates another person's rights.
  • Attempt to reverse engineer, decompile, or extract the source code of Mapinly.
  • Interfere with or disrupt the service, its servers, or networks — including through automated scraping, bots, or denial-of-service attacks.
  • Impersonate another person or entity.
  • Use Mapinly to send spam, unsolicited messages, or advertisements.
  • Attempt to access another user's account or data without their permission.
  • Upload files containing malware, viruses, or other harmful code.
  • Circumvent any usage limits, authentication, or security measures.

We reserve the right to determine what constitutes a violation and to take action accordingly.

7. Your Content & Data

"Your Content" means everything you create on Mapinly — trip plans, itineraries, notes, polls, checklists, idea lists, budget entries, uploaded files, and votes.

You own your content. We do not claim ownership of anything you create. We only use your content to operate the service for you — storing it, displaying it, and sharing it with the collaborators you invite. We do not sell your content to third parties.

When you delete it, it disappears from your dashboard. If you delete a trip, it is removed from your view and your collaborators' view immediately. Trip data is retained briefly in case you need help recovering it — reach out to our support team. If you delete your account, all your data is permanently removed from our systems.

Anonymized data. We may use anonymized, non-identifiable data (for example, popular destination trends or average trip lengths) to improve our product. This data cannot be traced back to you.

8. Intellectual Property

Mapinly's name, logo, design, code, and original content are owned by Mapinly and protected by applicable intellectual property laws. You may not use our branding, trademarks, or design elements without written permission.

Destination photos displayed on Mapinly are provided by Pexels and their photographers, used under the Pexels License.

Map data and place information is provided by Google and is subject to Google's Terms of Service.

9. Account Suspension & Termination

We may suspend or restrict your access if:

  • You violate these Terms or the Acceptable Use rules above.
  • Your account shows suspicious or potentially fraudulent activity.
  • We are required to do so by law or legal process.

Termination by us. We may terminate your account at our discretion with reasonable notice. If immediate termination is necessary (for example, illegal activity or a security threat), we may act without prior notice. If we terminate your account without cause, we will provide a pro-rated refund of any prepaid subscription fees.

Termination by you. You can delete your account at any time from your profile settings. Upon deletion, your data is permanently removed in accordance with our Privacy Policy.

10. Disclaimers

Mapinly is provided "as is" and "as available" without warranties of any kind, whether express or implied.

We do not guarantee that:

  • The service will be uninterrupted, error-free, or available at all times.
  • Third-party information (place details, map data, photos) will be accurate or up to date.
  • The budget tracking feature provides financial or accounting accuracy — it is an organizational tool, not a financial service.

We are not responsible for travel decisions you make based on information found through Mapinly. Always verify important details (hours, availability, safety) independently before traveling.

We perform regular maintenance and will try to give advance notice of planned downtime when possible.

11. Limitation of Liability

To the maximum extent permitted by law, Mapinly and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. This includes, without limitation, lost profits, lost data, missed travel plans, or costs of substitute services.

Our total liability for any claim arising from your use of Mapinly is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $50 USD.

These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

12. Dispute Resolution

Let's try to work it out first. If you have a concern or dispute, please contact us through our contact page. We will make a good-faith effort to resolve it informally within 30 days.

Arbitration. If we cannot resolve the dispute informally, either party may proceed to binding arbitration conducted under the rules of the American Arbitration Association (AAA). Arbitration will be conducted on an individual basis — not as a class, consolidated, or representative action.

Class action waiver. You agree that any dispute resolution will be conducted only on an individual basis. You waive your right to participate in a class action lawsuit or class-wide arbitration.

Small claims court. Either party may bring qualifying claims in small claims court as an alternative to arbitration.

Governing law. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

13. General Provisions

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mapinly regarding your use of the service.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.

No waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment. We may assign our rights and obligations under these Terms. You may not assign yours without our written consent.

Force majeure. We are not liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, internet outages, or government actions.
